RELEASE AND WAIVER OF LIABILITY

I. INTRODUCTION

A. Club Sports and Risks. The St. Louis Gaelic Athletic Association (“the Club”) is a non-profit club without shareholders, partners or other ownership. The games of hurling, Gaelic football, and camogie (“Games”) can be dangerous games. Due to the Games being contact sports and involving strenuous physical activity, the Games involve risks and dangers of serious bodily injury, including permanent disability, paralysis and death, and thus are, in fact, inherently dangerous. Injuries can and will occur to participants.

A spectator or a participant not currently on the field also is exposed to an inherent danger. For example, players or spectators may sustain injuries from loss of control, collisions, and contact with other participants, Gaelic footballs, sliothars (hurling or camogie balls), hurleys (hurling or camogie sticks), game posts, and other equipment.

B. Purpose of Release. By signing this document, the undersigned participant understands and accepts that he or she assumes a risk of harm or serious bodily injury by participating in these Games, and any practices, events, spectating, and Club-related activities, including, but not limited to, spectating. He or she participates in the Games and activities with the Club voluntarily and with full knowledge of the risks inherent in participating in these activities.

II. RELEASE, WAIVER OF LIABILITY, AND EXPRESS ASSUMPTION OF RISK

A. Consideration and Release. In consideration of the undersigned participant being allowed to participate inthe organization known as “St. Louis Gaelic Athletic Association” and games, practices, scrimmages, and/or events

organized or endorsed by the Club, the undersigned participant on behalf of himself or herself, the participant’s heirs, executors, administrators, successors and assigns releases, acquits, holds harmless, releases, enters into a covenant not to sue, and forever discharges the Club and its officers, directors, members, agents, servants, successors, heirs, executors, administrators, and all other persons, sponsors, firms, corporations, associations or partnerships associated with the Club, including any entity providing practice and playing fields (“Releasees”), of and from any and all claims, actions, causes of

action, demands, rights, damages, costs, expenses and compensation whatsoever, which the undersigned participant now has or which may accrue on account of or in any way growing out of any and all known and unknown, foreseen and unforeseen damages and the consequences resulting or to result from the undersigned participant playing, attending or traveling to and from any game, practice, scrimmage or event organized by the Club or its participants.

B. Participant’s Responsibility. The undersigned participant agrees and clearly, unambiguously, unmistakably, conspicuously and explicitly states that any bodily injury, disability, death or loss of personal property and expenses, including attorneys’ fees, incurred as a result of the participant’s own conduct or negligence or the conduct or negligence of any other participant or Club member is the participant’s own responsibility; and the participant understands, without condition or limitation, that the participant is releasing and holding harmless any party from his or her own future conduct or negligence. The participant further

agrees to assume all risks, known and unknown, arising out of or relating to games, practices, scrimmages,and/or events organized or endorsed by the Club.

C. Indemnification. The undersigned participant further agrees that if, despite this release and waiver of liability and assumption of risk, the undersigned participant, or anyone on the participant’s behalf, makes a claim against the Releasees, then the participant will indemnify, save and hold harmless each of the Releasees from any and all litigation expenses, attorneys’ fees, loss, liability, damage, or cost which may incur as the result of the claim.

D. Protective Equipment. Each hurling or camogie participant is strongly advised to wear protective gear, including, but not limited to, hand guards, a mouth guard and shin guards. A hurling or camogie player is required to wear a helmet with a faceguard at all times while participating in Club sponsored practices, scrimmages and games. Any hurling or camogie player who does not wear a helmet while participating in the Games or at Club sponsored practices does so at his or her own peril. Each football participant is strongly advised to wear protective gear, including, but not limited to, shin guards. A football player is required to wear a mouth guard at all times while participating in Club practices, scrimmages and games. St Louis Gaelic Athletic Association Release and Waiver of Liability.

E. Health of Participant. The undersigned and the participant represent that the participant is in good physical health and is in proper physical condition to participate in the Games and Club activities.

F. Disclosure of Terms. The participant further declares and represents that no promise, inducement, or agreement not expressed in this Release has been made to the undersigned or the participant, and that this Release contains the entire agreement between the parties, and that the terms of this Release are contractual and not mere recital.

G. Rules Requirement. The undersigned participant has read or agrees to read all of the official Gaelic Athletic Association (“GAA”) rules of hurling, camogie and Gaelic football before participating in any game, scrimmage, practice or event organized by the Club. The undersigned participant has read or agrees to read the most current version of the Club’s Handbook for the Games in which he or she will participate and further agrees that any violation of the GAA’s and Club’s rules may result in suspension or expulsion from participating in the Games and other Club-related activities.

H. Image and Likeness Authorization. The undersigned participant hereby authorizes consent to the use by the Club of his or her likeness and image in any and all publications, promotional materials, advertising, news media, and internet and social media materials. The undersigned participant understands and agrees that such materials, including all negatives, positives, digital images, videos and prints shall become and remain the sole property of the Club, and he or she shall have no right or title to such items. The undersigned participant agrees that the Club does not owe any compensation for the acts consented to in this agreement. The undersigned participant further understands and agrees that these materials may be kept on file and used by the Club for potential future purposes and further agrees to release the Club from any and all liability arising from or in connection with the taking, use, publication, or dissemination of such materials.

I. Knowledge. The undersigned participants acknowledges that they have carefully read this agreement, understands that they have given up substantial rights by agreeing to it, and fully understands its contents. The undersigned participant further agrees that, if any portion of this agreement is held to be invalid, the balance of the agreement shall continue in full force and effect. The undersigned participant enters into this contract of his or her own free will.

CODE OF CONDUCT

"Principles, values, standards, and/or rules of behavior that guide the decisions, procedures and systems of TheSt Louis Gaelic Athletic Association, aka St Louis Gaelic Athletic Club in a way that (a) contributes to the welfare of its key stakeholders, and (b) respects the rights of all constituents affected by its operations."The St. Louis Gaelic Athletic Association is herein referred to as the Club.

Rule 1. Respect & Integrity
Members are responsible for respecting the integrity and dignity of each and every Club member. Members are committed to making the Club a more inclusive organization based on mutual respect and appreciation for the diversity of the social network.

Rule 2. Representation
A member’s character and actions are a reflection of the Club’s reputation. A member shall not behave in a manner that adversely affects the reputation of the Club at any events.

Rule 3. Confidentiality
Club members are responsible for providing accurate and honest information. A member shall not share his/her login information or disclose any information about Club members to nonmembers, outside agencies, or commercial enterprises in any form, e.g. written, electronic, social media, and verbal.
Members have a right to:

1. Be treated fairly, equally and with respect by The Club, its Board of Directors and other members.

2. Socialize in an environment free from all forms of harassment and discrimination as defined by Federal, State and Local Laws, e.g. Title VII, Americans with Disabilities Act, Genetic Information Nondiscrimination Act.

3. Privacy and confidentiality concerning records, documentation and any other communication containing a member’s personal information, unless consent is specifically provided in accordance with Club Bylaws, Code of Conduct, Club President (or designated representative) approval, and affected member approval.

4. Be informed and actively involved in all Club events and offerings.

5. Voice their opinions, requirements and suggestions to the Board of Directors.
Members must:

1. Treat other members, guests, staff of venues and other patrons (where a social club function is being held fairly, equally and with respect and courtesy.

2. Behave legally, responsibly and conduct themselves in a manner which will not harm, cause embarrassment or injure the reputation of the Club, its events, organizers, participants or sponsors. Irresponsible and/or illegal behavior includes reckless driving, driving while under the influence, and inappropriate behavior.

3. Only publicize videos, pictures, calendars and other media that are tasteful and uphold the integrity and dignity of the Club membership, determined by a vote of the Board of Directors.

4. Not physically or verbally harass others.

5. Report any inappropriate behavior of a member to the Board of Directors of the Club for action and follow up.

6. Abide by and uphold the By-Laws and Code of Conduct of the Club.

7. Pay any fees in relation to an event, or offering (e.g. tickets, memberships, event fees) which that member has committed to, regardless of whether the member attends the event or not.

8. Notify the Board of Directors of any changes to address or other information.
Breaches of this Code of Conduct:

1. Any member not behaving in accordance with the terms of the Code of Conduct at an event of the Club may be asked to leave the function and will not be entitled to a refund of any monies paid.

2. The inappropriate behavior of any members will be investigated, discussed and an appropriate course of action will be taken by the Board of Directors by unanimous vote, which may include a warning, suspension or revocation of membership.

3. In appropriate circumstances related to National Events, the Board of Directors may refer a breach of the Code of Conduct to the regional Heartland GAA and/or USGAA.
